Protective Property Trust

A Protective Property Trust is another way to protect your home when you pass away. A Protective Property Trust allows you to split your home between you and your spouse/partner, with the share of the first person to die being passed into Trust.

The surviving spouse/partner controls the Trust and is guaranteed the right of occupation for as long as they want. The Trust is flexible and furthermore, allows the sale of the property and the purchase of a new one. The surviving spouse/partner also has access to any funds left over following the purchase of a new home.

Property Trusts are ideal for couples who, on the first death, want to protect half of their residential property from the cost of future long-term-care fees for the surviving spouse/partner.

What Are The Benefits of A Property Trust?

  • A Property Trust guarantees you, or your surviving spouse, occupancy of your home.
  • There are no adverse income tax consequences.
  • A Property Trust allows you the freedom to move house.
  • As the Trust doesn’t come into effect until the death of the first spouse, you can alter the Will & Trust at any time while you are alive.
  • A Protective Property Trust allows access to any spare funds created by the sale of the property.
